Welcome to fiftysite.com (“we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your use of our website and our website creation and hosting services (“Services”).
By using our Services, you agree to these Terms. If you do not agree, please do not use our Services.

1. Overview of Services

FiftySite provides an all-in-one website solution for small businesses starting at $50 AUD per month.

The basic plan includes:

Website creation (standard business website)
Secure hosting and ongoing maintenance
One business email address
Technical support for one standard website change per month

Additional costs may apply for services or features not included in the basic plan, such as:

Domain name registration or renewal
SSL certificate setup (if not included by the hosting provider)
More than one website change per month
Custom design, eCommerce setup, or integrations
Additional email accounts or storage upgrades

Please refer to our Schedule of Charges or contact us directly for a detailed quotation before ordering additional work.

2. Payment & Billing

The minimum monthly fee of $50 AUD is payable in advance.
Additional fees for extra services will be invoiced separately or added to your monthly billing cycle.
All prices are in Australian Dollars (AUD) and include GST unless stated otherwise.
Payments must be kept current to ensure uninterrupted hosting and maintenance.
We reserve the right to review and update pricing or inclusions, with notice provided in advance.

3. Domain Names and SSL Certificates

Domain registration, renewal, and SSL certificates can be managed by us on your behalf or directly by you.
These costs are separate from the base service fee.
You retain ownership of domains registered in your name and are responsible for ensuring timely renewal.
We are not liable for downtime or loss of access caused by expired domains, SSL issues, or third-party registrar failures.

4. Website Updates & Maintenance

The standard plan includes one website change per month (e.g. text, image, or minor layout update).
Additional updates beyond the included one per month may incur charges as outlined in the Schedule of Charges.
Routine maintenance and security updates are included as part of the plan.
We reserve the right to reject excessive or out-of-scope change requests under the standard plan.

5. Uptime, Speed & Technical Limitations

We strive to maintain 99% uptime for hosted websites.
Temporary downtime or slower performance may occur due to maintenance, server load, or network issues beyond our control.
While we take reasonable measures to ensure reliability and speed, we do not guarantee uninterrupted operation or specific performance levels.
FiftySite is not liable for any loss of business, revenue, or data resulting from downtime, speed limitations, or hosting interruptions.

6. Client Responsibilities

You must provide accurate and lawful content (text, images, business details) for your website.
You are responsible for ensuring that the material you provide does not infringe copyright or other third-party rights.
You agree not to use the website or hosting for illegal, harmful, or misleading purposes, including spamming, malware, or phishing.
We reserve the right to suspend or terminate services immediately if your website content violates laws or these Terms.

7. Ownership and Intellectual Property

Once all fees are paid in full, you own the website content and custom design created for you (excluding third-party themes, plugins, or software licenses).
FiftySite retains ownership of any proprietary tools or frameworks used in developing or maintaining websites.
You may not reproduce, resell, or redistribute our proprietary materials without written permission.

8. Cancellation & Termination

You may cancel your subscription at any time by giving 7 days’ written notice before your next billing cycle.
We may suspend or terminate your service immediately if:
- You fail to make payments when due,
- You breach these Terms, or
- Your hosted content is illegal or harmful.
Upon termination, hosting will cease, and your website files may be deleted unless otherwise arranged and paid for.

9. Limitation of Liability

To the maximum extent permitted by law, FiftySite and its staff are not liable for any indirect, incidental, or consequential losses, including loss of profits, customers, or data.
Our total liability for any claim will not exceed the total amount paid to us in the past 12 months.
Nothing in these Terms limits your rights under the Australian Consumer Law (ACL).

10. Indemnity

You agree to indemnify and hold harmless FiftySite and its employees against any claims, damages, or costs arising from your use of our Services or your breach of these Terms.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy. By using our Services, you consent to the collection and use of your data as described in that policy.

12. Updates to Terms

We may revise these Terms from time to time. The latest version will always be posted on fiftysite.com, and your continued use of our Services indicates acceptance of any updated Terms.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and any disputes will be resolved under the jurisdiction of the courts of New South Wales.
